FOCUS: Nonresident Alien Tax Compliance - Update, Review and Design

The FOCUS: Nonresident Alien Tax Compliance - Update, Review and Design workshop is designed for individuals who have a basic, intermediate or advanced level of understanding of nonresident alien tax issues. This is a fast-paced workshop-- FOCUSing on policy and procedure development. This is an excellent opportunity to work with our professionals to brainstorm the best practices to identify foreign nationals, collect data, make tax determinations and ensure broad-range compliance. We will FOCUS on the "paper flow" and "people flow" aspects of developing a comprehensive and efficient tax compliance game plan. For institutions that already have policies and procedures in place, we FOCUS on the review of your current procedures to determine how you can streamline processes and ensure that all payment systems are properly addressed. FOCUS workshop participants are encouraged to have the Volume One, 2008 edition text with them at the workshop; attendees may bring their own copy or purchase one in addition to their workshop registration. This workshop is designed for a small, detailed and FOCUSed discussion -- registration is limited so please register early.

Comprehensive Level: More Than Just the Building Blocks

The Comprehensive Level workshop is designed for individuals who have a basic level of understanding of nonresident alien tax issues and have worked in the area for about a year. This is a fast-paced workshop in which the faculty will teach the "building blocks" of this complex area of the tax law. In many cases, individuals have simply been "thrown into" this area, with no instruction -- this course is designed to take someone back to the basics and learn the most efficient manner to approach this issue. There will be faculty instruction, practical examples, and case studies for each section, as well as time for individual questions. By the end of the workshop, all the steps are pulled together to ensure attendees get all the details, yet still see the big picture.

But the Comprehensive Workshop does not end on Tuesday - the workshop continues on…… This year the Comprehensive Workshop registration gives you another learning opportunity to build on your nonresident alien tax compliance knowledge base even after the two day workshop is over!

We've read the evaluations and we've heard your comments - you've learned so much in the past two days but it would be really nice to have a refresher call after you've had a chance to apply what you've learned at the workshop, to the situations you encounter at your institution. So, all Comprehensive workshop participants can join in on a one-hour conference call to discuss the take-home exercises and reiterate the building block approach to dealing with payments made to foreign nationals. And, each participant will have an opportunity to participate in a 20 minute one-on-one call with one of Arctic's professionals - who is available to answer your specific questions! Intensive Level: Becoming More Efficient

We have totally revamped the Intensive Level workshop. This level is designed for individuals who have several years of experience in working with nonresident alien tax issues. At this workshop, we take an in-depth look at the complexities of nonresident alien taxation. We focus on residency status, tax withholding and reporting issues.

We strongly suggest that this workshop be combined with one of our other focused sessions such as Update of the Issues, Income Tax Treaties, "Are You Ready to Report?", Nonresident Alien Tax Compliance, and/or "FOCUS". The Intensive Level also uses Nonresident Alien Tax Compliance: Volume One , 2008 edition as it manual. Update of the Issues - What's Happened in the past 18 months

The UPDATE workshop is about more than just the rules! During the past few years, there have been many changes, with new income tax treaties to new tax withholding and reporting regulations taking effect. It's important to ensure that you and your institution are using the latest information and are up to date on the issues. At the Update, participants will have a chance to ask in-depth questions about situations happening at their institution and to discuss the more broad and complex issues with the faculty. This workshop is designed for individuals who have been working in this area of taxation for several years, have a solid understanding of the issues, and simply want to find out about changes and trends over the last year.

Open Forum and Luncheon (A Chance to interact with your colleagues and the faculty) (New!)

We read the evaluations and we’ve heard your suggestions regarding more time with the faculty and more time networking with your colleagues -- so we’ve added a new Open Forum and Luncheon Session. This new session is open to all workshop participants and will focus on a discussion of current nonresident alien tax issues at tax exempt organizations. What a great opportunity to join other workshop participants in discussing the issues you face on a day-to-day basis -- and, enjoy a wonderful buffet luncheon.

Open Forum and Luncheon participants will have an opportunity to ask questions of the faculty, network with your colleagues, share best practices, and have a great lunch. You will be able to submit questions for discussion prior to the session, as well as have the faculty and guest speaker available for an interactive forum during the session. At the Income Tax Treaties: An In-Depth Discussion workshop, we look at the complexities of income tax treaties, including the restrictive clauses, payments to artists/performers, payments to independent contractors, the business profits articles, as well as all the applicable forms. This workshop is designed for individuals who have a solid working knowledge of nonresident alien tax compliance and who need to take a step beyond that basic understanding to learn about tax treaties.. Are You Ready to Report?

The Are You Ready to Report? workshop is about more than just reporting! Reporting is one of the last steps. By the time the withholding agent is ready to report payments made to nonresident aliens, it’s too late to go back and collect information or correct situations. This workshop is designed to alert attendees to the information that must be collected, tracked and tested long before Forms 1042-S are ready to be prepared. Then, when all the information is complete and correct, the faculty will show how the forms should be completed, submitted, and corrected.

Many people think that because they are not the ones who actually complete Form 1042-S, they don’t need to know about reporting issues. If you are responsible for making nonresident alien tax compliance decisions at your organization, you need to know what information to collect, how to track it, and how to organize it for year-end reporting. You’ll also learn how the actions you take as a withholding agent affect the individual when he or she files an income tax return.

Immigration Issues for the Tax/Payroll Professional

This workshop is designed for the tax professional who needs a better understanding of the overlap of immigration and tax issues. We will discuss immigration issues as they relate to foreign nationals generally associated with and/or paid by not-for-profit entities. The focus of this workshop is on getting the tax professional up to speed with immigration terminology, documentation, and general concepts. We will also discuss work authorization, immigration compliance and record keeping, and the latest immigration news related to visitors to the U.S. (B-1/B-2 and waivers). The text for this workshop is our updated book, entitled Immigration and Tax - At the Crossroads: Immigration Issues for Tax and Payroll Professionals, 2004 edition. Responsibilities of the Nonresident Alien Tax Specialist

This workshop is designed to help Nonresident Alien Tax Specialists carry out their duties more effectively and efficiently. As a Nonresident Alien Tax Specialist, it is important to understand the technical tax issues that you face, but there is more to the job than technical proficiency. Implementing and maintaining an effective nonresident alien tax compliance program requires organization and constant monitoring. This workshop will give you practical tips in carrying out important duties and responsibilities, such as:

  • Setting up your nonresident alien tax files to ensure completeness and consistency
  • Reviewing tax documents for compliance with ever–changing tax rules and regulations
  • Conducting a Mock Audit to assess strengths and identify areas for improvement in your nonresident alien policies and procedures
  • Identifying steps to be taken during the year to identify withholding and reporting issues before year end
  • Avoiding "roadblocks" when implementing and maintaining policies and procedures for nonresident alien tax compliance

The Form I-9 Process - A Closer Look

Forms I-9 may be completed at numerous locations at an institution. With a decentralized approach to Form I-9 collection and processing, compliance with the complex rules can be difficult. An effective Forms I-9 process is crucial not only to maintaining compliance with nonresident alien tax rules but in maintaining compliance with immigration rules as well. Failure to properly complete and maintain Forms I-9 can lead to fines and even debarment from receiving government contracts. How good are your Form I-9 policies and procedures? When is the last time they were updated?

This workshop will help participants evaluate and strengthen their current Forms I-9 process. In this workshop we will discuss current Forms I-9 requirements and proper procedures for meeting these requirements, including Forms I-9 file maintenance, training for those involved, and when Forms I-9 need to be recertified and the proper way to do it. If your institution hasn't evaluated its Forms I-9 policies and procedures in the last year, this workshop is a must for you!

In our other workshops, we focus on the rules and regulations relating to payments made to nonresident aliens by looking at ALL payment systems at an institution - payroll, accounts payable and student accounts. Many of our attendees deal only with payments through ONE payment system. This new focused workshop is designed for those workshop participants with responsibilities related to employees (e.g., generally associated with the Tax, Human Resources and Payroll departments). Participants in this workshop must have attended the Comprehensive Level workshop either during this or a prior workshop series. This workshop will focus not only on the "What" (the specific tax withholding and reporting rules related to payments made to employees), but more importantly on the "How" (the process and procedures applicable to payments made through these areas – what needs to be considered and how to approach it.

This workshop is designed to bridge the gap between the rules and the process, in other words, between the "What Do I Need to Do" and "How Should I Do It". If you are the Nonresident Alien Tax Specialist or a person in the Tax, Human Resources or Payroll departments – this is the workshop for you - we’ll see you there!

Nonresident Alien Tax Compliance: Are You Ready for an Audit? (A Closer Look at What Your Institution Should be Doing to Prepare for and Conduct a Mock-Audit to Ensure You’re in Compliance)

The IRS has indicated that it will be contacting even more institutions this spring to assess their level of compliance with the nonresident alien tax withholding and reporting rules. Are you ready? ...Are you sure?!
