    Comprehensive Course

    What Participants Will Learn:

    • The "building blocks" of nonresident alien tax compliance;
    • How to work through a situation from beginning to end;
    • The mechanics of how to determine U.S. residency status, including how to calculate the substantial presence test and exceptions thereto;
    • The importance of determining the category of income and the issues associated with doing so;

      • U.S. Taxable Income: In-Depth Discussion of Determining the Type of Income Paid provides a detailed discussion of non-services type payments - scholarships / fellowships, royalties, prizes and awards. Additional time is spent on defining fair market value for compensation purposes.
      • U.S. Tax Withholding Issues: In-Depth Discussion covers the income tax withholding rules and exclusions. Additional discussion on reducing the taxable base using Revenue Procedure 88-24.
      • FOCUS: Payments to Foreign Companies and Other Entities provides a discussion pertaining to when payments are taxable and reportable. The class includes a discussion on activities considered U.S. trade or business and effectively connected income.
      • FOCUS: Withholding Agent Responsibilities discusses the concept of the withholding agent as it pertains to making payments to foreign nationals.
      • Open Forum - Discussion of Advanced Issues and Special Topics provides instruction on dealing with "grossing up" payments, third-party payments as well as payment to business visitors. Reporting of foreign bank accounts and short-term grantees are covered as well.

    Who are the instructors?

    Donna E. Kepley
    Anne-Marie Burns

    Donna E. Kepley

    Ms. Kepley is the President of Arctic International LLC, an international tax consulting firm. Prior to forming Arctic, she was the Director of the International Tax & Legal Centre in KPMG's International Headquarters in Amsterdam, The Netherlands. Before accepting her international assignment, Ms. Kepley served as KPMG's National Director of Nonresident Alien Tax Compliance. Ms. Kepley began her professional practice as the Director of Tax Compliance Programs at Baker & McKenzie, an international law firm.

    Ms. Kepley is the author of several books on the topic of nonresident alien tax issues and is a frequent speaker at national conferences on the issue of nonresident alien tax compliance. She focuses primarily on nonresident alien tax issues and works primarily with colleges, universities, and other non-profit and corporate entities to develop and maintain tax compliance programs, establish policies and procedures, conduct training programs, and review/design payment software systems.

    Anne-Marie Burns

    Ms. Burns is the Director, Tax Compliance with Arctic International LLC. She has primary responsibility for controversy resolution issues and works with many clients to assist in their nonresident alien tax compliance audits and reviews. She has extensive knowledge in determining past tax liability and identifying nonresident alien target populations. Prior to joining Arctic, she was a Senior Manager in KPMG LLP's Southwest Exempt Organizations Tax Practice. She has worked with many not-for-profit institutions to provide guidance on tax issues primarily focusing on nonresident alien tax compliance. Ms. Burns is a frequent presenter at regional and national conferences on tax issues affecting the higher educational community, specifically nonresident alien tax compliance issues.

    What Materials Will I Need?

    Nonresident Alien Tax Compliance: A Guide for Institutions Making Payments to Foreign Students, Scholars, Employees, and Other International Visitors - Volume One, 2011 edition, authored by Donna Kepley serves as the Comprehensive Level and Intensive Level Tax Workshops' primary text.

    Comprehensive and Intensive Level workshop participants should have a copy of the 2011 edition with them; please remember that this book is shipped so allow time for receipt prior to the WEBshop start date.

    All other materials will be made available to WEBshop participants electronically via secure login to their Arctic Client Portal Profile. Materials will be available approximately three days prior to the Class start date and will remain available online for 30 days after the Class start date. Participants should download and/or print materials prior to the Class start time.

    Can I participate in multiple WEBshops?

    At Arctic International LLC, we want to empower our clients to better understand the complex issue of nonresident alien tax so that they may more efficiently manage their institution's process for making payments to foreign nationals. We strongly encourage our clients to attend On-Site Workshops; however, we understand that budget issues and time out of the office may not accommodate such training. Our Courses are designed to be taken together and thus we offer discounted pricing to do so.

    We also believe that being in compliance takes more than one well-trained person! The "Nonresident Alien Tax Specialist" must not only have a back-up, but must have the cooperation and understanding of many others at the institution, including those in Payroll, Accounts Payable, Student Accounting, Human Resources, Controller's Offices, General Counsel, Grants and Contracts, International Student and Scholar Office - and just about anyone else who might be interested in the topic.     Will I receive CPE credit?

    Arctic International LLC is registered with the National Association of State Boards of Accountancy ("NASBA") as a sponsor of continuing professional education of the National Registry of CPE Sponsors. State boards of accountancy have final authority on the acceptance of individual courses for CPE credit. Complaints regarding registered sponsors may be addressed to the National Registry of CPE Sponsors, 150 Fourth Avenue North, Nashville, TN, 37219-2417.

    CPE credit is based on a standard process (1 CPE for each 50 minutes of instruction). We are currently in the process of applying for our WEBshop Training to be covered under our CPE registration.

    WEBshop Registration Policies

    • All WEBshop registrations must be made online;
    • Arctic International LLC prefers payment for ARC WEBshop Training via Visa or MasterCard so as to accommodate late registration. The credit card does not need to be in the name of the PRIMARY WEBshop Participant. If you prefer to pay by check, the check must be received by us at least 24 hours PRIOR to the start time of the Registrant's first WEBshop class; please plan accordingly as no exceptions will be made.
    • WEBshop pricing is subject to change at any time. Pricing for WEBshop Packages or Segments already registered for will not change; however, additional Packages and/or Segments to be added will be subject to pricing in place at the time of the addition and/or modification.
    • Primary WEBshop Participant will receive an e-mail confirmation of the registration from ARCtraining@arcticintl.com immediately after the successful completion of the registration. If an email is not received, the spam filter should be checked; if an e-mail confirmation of the registration is not received, please call Arctic International LLC at info@arcticintl.com.
    • ARC Training WEBshops are designed for individuals from non-profit and/or federal/state governmental entities; we reserve the right to limit registration to such entities and/or charge a different registration fee to other types of entities. We further reserve the right to decline a registration request from any individual or institution for any reason.
    • Registration is on a per-individual basis and allows access via one phone line. For an additional registration fee, up to four other individuals from the same institution/campus/ legal entity may participate with the Primary WEBshop Participant.
    • The registration fee includes:
      • Online access to WEBshop materials;
      • Ability to submit Pre-WEBshop Survey, indicating specific issues of interest, as well as submission of questions and possible case studies;
      • Login instructions for each WEBshop Class included in the Course of Study for both a online and telephone component. Telephone dial-in will not be a toll-free number;
      • Each class is a 75-minute segment that includes 55 minutes of instruction and 20 minutes of case study, participant discussion, and Q&A;
      • Ability to access recorded WEBshop discussion and presentation for up to one week after each WEBshop Class start date;
      • Depending on the Course registered for, access to ICE: Participants will have the opportunity to interact with the faculty and conduct research via the Nonresident Alien Tax Forum on ICE (Information, Communication, and Exchange bulletin board) during the WEBshop Course period; and
      • Ability to take Post-WEBshop Evaluation.
    • All Comprehensive Level and Intensive Level WEBshop participants should have the WEBshop text, Nonresident Alien Tax Compliance: Volume One - (2011) edition; the book may be purchased prior to the WEBshop start date; however, WEBshop participant should allow time for shipping;
    • Prerequisites: There are no prerequisite course work or experience levels required for the Comprehensive Level and Special Issues WEBshops. Participants in the Intensive Level, Update, Income Tax Treaties, Reporting, FOCUS: Process must have attended or participated in our Comprehensive Level or Intensive Level workshops or WEBshops within the past 24 months or have at least two years of experience in nonresident alien tax issues;
    • Advance Preparation: To prepare for the workshops, you should take the Pre-Workshop Survey from your Client Portal Workshop Detail page, submit any special questions or cases you have, and print/review the materials prior to the workshop. Otherwise, there is no other advance preparation necessary.
    • Arctic International LLC may cancel any WEBshop due to low enrollment. In the unlikely event of a WEBshop cancellation, all registered participants will be notified via email at least three business days before the class start date. In the event of a cancellation, a Credit Notice will be issued to the registered institution that may be used for up to one year after the cancellation.
    • If a registered participant is unable to participate, an alternate participant may designated or the registration may be canceled no later than three business days prior to the Course (if applicable) or Class start date. To designate an alternate participant, the Primary WEBshop participant must contact Arctic International LLC at info@arcticintl.com with the name of the alternate participant's name and email address. No alternate participants may be designated after the start of the Course (if applicable) or the Class start date.
    • Our WEBshop cancellation policy is as follows: No cancellations within three business days of the Course (if applicable) or Class start date or after the start date; If a participant cancels the registration prior to three business days before Course (if applicable) or Class start date, the institution will receive a Credit Notice for the registration fee less $50 cancellation fee. No partial refunds will be made for reduced Additional Participant cancellation. Credit Notices may be used for any future ARC Training registration, book purchase, or software licensing fee.
